Disclaimers and Notices for Communications
All political ads and communications must bear a clear, conspicuous disclaimer stating who paid for them. Specifically, we will use language like “Paid for by Constitutional Conservatives of South Carolina (ccsc.info)…” and then indicate authorization. For unauthorized communications, we explicitly say “…and not authorized by any candidate or candidate’s committee”. If a candidate has authorized a message, our disclaimer will instead say “…and authorized by [Candidate’s Name] [for Office]” . In all cases the disclaimer must include our full committee name and either our street address, phone number, or website.
For example:
“Paid for by the Constitutional Conservatives of SC PAC (ccsc.info) and not authorized by any candidate or candidate’s committee”
Disclaimers also apply on our website and email blasts. Federal law treats public websites and mass emails as “communications,” so the same rules apply. We will place a visible disclaimer on the homepage and donation pages, and include the required text in any email to more than 500 recipients. All disclaimers will meet the FEC’s “clear and conspicuous” standard. In short, every campaign flyer, web graphic, or newsletter will say who paid for it and whether it was candidate‐approved, following the FEC examples.
All online solicitations and merch sales must also include the above disclaimer about who paid for the communication. In addition, by law we must notify donors that contributions are not tax-deductible. For example, our donation page and solicitations will include a statement like “Contributions to CCSC are not tax-deductible for federal income tax purposes” (required when receipts exceed $100K). We will also comply with reporting rules: for any donor giving over $200 in a calendar year, we will request their name, address, occupation, and employer (the FEC’s “best efforts” requirement) and notify them that the information is required by law. In practice, our donation form will include fields for this information and a note such as “By law we must collect and report your name, address, occupation and employer for donations over $200”.
Any marketing email we send will comply with the CAN-SPAM Act. This means every email will include our valid postal address and a clear unsubscribe link or instructions. We will honor opt-out requests within 10 business days and never send further emails to someone who has unsubscribed. In summary, our emails will identify the sender, include contact info, and offer a simple way to unsubscribe.
(Our disclosures follow Federal Election Commission guidance on disclaimers and fundraising notices, FTC guidance on email marketing, and best practices for privacy/security . These policies ensure full legal compliance for the CCSC PAC’s website and communications.)
